1. Criteria
When young people with Physical Disabilities or Complex Health Needs reach the age of 18, case responsibility will transfer from Children’s Division to the Physical Disabilities Team.
The young person is deemed to be a child in need and is therefore not subject to Child Protection Registration or legal proceedings or any kind of overnight looked after arrangement, be this either respite or full time.
AND
The assessment and/or review clarifies that the young person is wishing to achieve greater independence, this will include support within the home or the community.
2. Arrangements for Looked After Young People or Young People Subject to Child Protection Registration or Legal Proceedings
Where the young person meets the criteria of the 16-30 Project, Physical Disabilities Team, the Project will provide a consultancy service or joint work where consultancy cannot adequately achieve the required outcome.
3. Arrangements for 1416 year olds
The 16 -30 Project will provide consultation to Children’s Division in the following circumstances:
- Where independent living is identified as a key issue for the young person;
- Where decisions made by Children’s Division could have a significant impact upon the young persons transition from the age of 16-21. Key decisions include decisions on placements away from home or agreements to fund home support arrangements, which are likely to be long term.
4. Responsibilities for Families where the Parent and the Child/Young Person has a Physical Disability
- Where the child or young person and their parent both have a physical disability there will be a shared assessment process, which ensures that needs are identified and addressed. It will remain the responsibility of the two services to complete their own assessment/care management documentation;
- Where the outcome of the assessment indicates that home support is required then costs will be apportioned according to the respective needs of the child or young person and the parent. Where it is not possible to apportion responsibilities in this way then the costs will be shared on a fifty-fifty basis;
- Where only the parent has a physical disability then the costs for any home support will be fully met by the Physical Disabilities Team.
5. Practicalities
- Where transfer of case responsibility is agreed then the file should be transferred to the , Physical Disabilities Team;
- Case files will be required to meet departmental standards. Therefore there will be:
- A transfer summary;
- An up to date assessment or/and a review which has been held within the previous six months.
- Children’s Division should notify, where possible, the, Physical Disabilities Team of its wish to transfer a case twelve weeks prior to the young persons 16th birthday;
- Joint visits will be required where there are complex issues to be addressed;
- Where the young person is 16 years old and the young person meets the criteria for a service from the Physical Disabilities Team, but the file is currently dormant, then the case file should remain with Children’s Division until the young person is re-referred or is 18 years old. When a re-referral occurs it is expected that Children's Division will undertake an assessment to determine that a service from the Physical Disabilities Team is appropriate.
6. Resolution of Differences
It is expected that any difficulties in relation to transfers will be resolved between the Senior Care Managers of the respective teams. If a resolution still cannot be achieved then the Service Managers will make the final decision.
